The Declaration of human rights

X World Russian National Cathedral has taken place in the beginning of April 2006. On it the Declaration on the rights and advantages of the person " has been accepted on April 2006 ".. In this declaration firmness to " the General declaration of human rights ", by the accepted General Assembly of the United Nations on December, 10, 1948 has been subjected to doubt. However specific proposals on updating of " the General declaration of human rights " has not followed. I think, that basically the specified document of the United Nations is not root of all evil in the modern world. All clauses and positions are quite comprehensible, reasonable and proved by traditional morals and all historical religions, except for first and twenty ninth clauses.

"Clause 1. All people are born free and equal the advantage and the rights. They are allocated reason and conscience and should act in attitudes each other in spirit of a brotherhood"
Why people are allocated only reason and conscience? Whom are they allocated? Definition of a private world of the person by reason and conscience is not enough. The reason is responsible for material consciousness. Conscience this moral consciousness, skill to distinguish kindness and is angry, consciousness of the moral responsibility for the behavior. But the reason and conscience do not make acts, it only consciousness. The person makes acts on the basis of the will. And the will can be kind or malicious, serve a life or death. Therefore the person from a birth possesses as well freedom of will. An opportunity to make acts on the basis of the free choice.
In the document it is offered to make acts in human attitudes in spirit of a brotherhood. What brotherhood? How the person without conscience or with conscience of service of death can act with the person possessing conscience of service of a life, fraternally? They never spiritual brothers will be. The mortal sin of the homosexual does not cause in believing people of sensation of a brotherhood with it. The offer of construction of attitudes in spirit of a brotherhood is false and erroneous, simply provocation and serves blossoming of evil on the ground.
Except for the rights and freedom exist also duties. The following is told about it:

"Clause 29.

1. Each person has duties before a society, in which only both probably free and full development of his person.
2. At realization of the rights and freedom each person should be exposed only to such restrictions what are established by the law extremely with the purpose of maintenance of a due recognition and respect of the rights and freedom of others and satisfaction of fair requirements of morals, a public order and the general well-being in a democratic society …"

I believe, that the contradiction of the rights and duties lays not in a plane of freedom, and in philosophical and religious definition of freedom of will to which the place in " The General declaration of human rights " was not found. I think, that it has been made deliberately. Realization of the rights and freedom is connected to freedom of the will just establishing restrictions on the rights and freedom. But these restrictions are defined not by the formal laws accepted in each concrete country, and universal both traditional private positions and rules of morals and validity. Freedom of will exists in two variants. She can be not dependent from will of the God, referring to in determined, and can be dependent from will of the God then she is determined. It turns out, that atheists and believing in Satanism are devoted self-sufficiency of the person and in determined in freedom of will, and the admirers of any traditional religion believing in existence of the Creator, the God or Gods, are determined in freedom of will. They impose on themselves the voluntary restrictions connected to laws Mousey, Jesus Christ's sermons, Islamic, буддистскими or others traditional and historical values. For the believing person there is only determined freedom of will.

"The general declaration of human rights" has balanced in the rights and freedom of atheists and believing people, missing from attention divine essence of the person, and also a question on an origin of the person and all world. Who has created this world, God, either Chaos, or the Nature? Whether it is correct, whether it is possible to destroy with the stroke of the pen historical and religious values of mankind only that atheists and Satanists were not restrained in the rights and freedom? On a freedom of worship, i.e. freedom of idea, conscience, and religion nobody selected their right and did not limit. Them all one - two hundred millions person on the Earth. Why the others some billions person should pretend, what their rights and freedom are not restrained by absence of a recognition of existence of the God? Democracy is will of the majority, at a recognition of the rights and freedom of minority.

Accordingly I believe, that the World Russian National Cathedral should bring in updating to " the General declaration of human rights ", concerning a recognition peoples of the Earth existence of the God of the Creator, divine essence of the person and presence of determined freedom of will. It also will be the contribution of the Orthodox civilization and Russian people to construction of the new future for the mankind based on ideals of goods and validity.

Besides in the Declaration not words it is not told about human rights on the truth and access to the information. Absence of the right on the truth or restriction of the truth and the information it is a version of oppression or bondage. This bondage is born a manipulation the truth and lie that breaks birth rights of the person. I believe, that it is necessary to add the Declaration to Clause 7:

"Clause 7. Each person has the right to the truth and access to the information"

Corrected clauses, in view of increase in quantity of clauses up to 31, will sound so:

"Clause 1. All people are born free and equal the advantage and the rights. They are allocated the God reason, conscience and freedom of will. People should act in attitudes with each other in spirit of goods and validity"

" Clause 7. Each person has the right to the truth and access to the information"

"Clause 30.

1. Each person has duties before a society, in which only both probably free and full development of his person.
2. At realization of the rights and freedom each person and his freedom of will should be exposed only to such restrictions what are established by the law extremely with the purpose of maintenance of a due recognition and respect of the rights and freedom of other people and satisfaction of requirements of goods, validity, morals, a public order and the general well-being in a democratic society
3. Realization of these rights and freedom should not contradict the purposes at all and to principles of the United Nations Organization"

The corrected text of " the General declaration of human rights " we shall simply name " the Declaration of human rights " and we shall result it below:

The Declaration of Human Rights

Clause 1

All people are born free and equal the advantage and the rights. They are allocated the God reason, conscience and freedom of will. People should act in attitudes with each other in spirit of goods and validity.

Each person should possess all rights and all freedom proclaimed by the present Declaration, without any distinction, somehow: concerning race, color of a leather, a floor, language, religion, political or other belief, national or a social origin, property, class or other position.
Besides it should not be carried out any distinction on the basis of the political, legal or international status of the country or territory to which the person belongs, irrespective of, whether this territory independent, trust territory, don't severing, or as - or differently limited in the sovereignty is.

Each person has the right to a life, on freedom and on inviolability of person.

Nobody should contain in slavery or a dependent condition; slavery and slave trade are forbidden in all their kinds.

Nobody should be exposed to tortures or the reference severe, brutal or humiliating advantage and punishment.

Each person where it was has the right to his recognition right subject.

Each person has the right to the truth and access to the information.

All people are equal before the law and have the right, without any distinction, on equal protection of the law. All people have the right to equal protection against any discrimination breaking the present Declaration, and against any instigation to such discrimination.

Each person has the right to effective restoration in the rights competent national courts in case of infringement of his fundamental laws given to it by the constitution or the law.

Nobody can be subjected to any arrest, detention or exile.

Each person for definition of his rights and duties and for an establishment of validity of the criminal charge showed to it has the right, on the basis of full equality, on that his business has been considered publicly and with observance of all requirements of validity by independent and impartial court.

1. Each person accused of fulfillment of a crime, has the right to be considered innocent until his guilt will not be established by lawful order by public proceeding at which to it all opportunities for protection are provided.
2. Nobody can be condemned for a crime on the basis of fulfillment of any act or for inactivity which during their fulfillment did not make a crime under national laws or on international law. Punishment heavier, rather than what could be applied cannot be imposed also when the crime has been accomplished.

Nobody can be exposed to any intervention in his personal and home life, to any encroachments on inviolability of his dwelling, secret of his correspondence or on his honor and reputation. Each person has the right to protection of the law against such intervention or such encroachments.

1. Each person has the right to move and choose freely to itself a residence within the limits of each state.
2. Each person has the right to leave any country, including own, and to come back in the country.

1. Each person has the right to search for a refuge from prosecution in other countries and to use this refuge.
2. This right cannot be used in case of the prosecution actually based on fulfillment of not political crime or act, contradicting to the purposes and principles of the United Nations Organization.

1. Each person has the right to citizenship.
2. Nobody can be any way deprived the citizenship or the right to change the citizenship.

1. Men and the women who have reached majority, have the right without any restrictions on the basis of race, nationalities or religions to marry and found family. They have the identical rights concerning the introduction into a marriage, during a condition in a marriage and during his cancellation.
2. The marriage can be made only at the free and full consent of both marrying parties.
3. The family is a natural and basic cell of a society and has the right to protection on the part of a society and the states.

1. Each person has the right to own property as individually, and together with others.
2. Nobody should be any way deprived the property.

Each person has the right to freedom of idea, conscience and religion; it includes freedom to change the religion or belief and freedom to profess the religion or belief both individually, and together with others, public or private order in the doctrine, divine service and performance of religious and ritual orders.

Each person has the right to freedom of belief and on free expression of them; this right includes freedom free to adhere to the belief and freedom to search, receive and distribute the information and ideas by all means and irrespective of frontiers.

1. Each person has the right to freedom of peace assemblies and associations.
2. Nobody can be forced to enter any association.

1. Each person has the right to take part in management of the country directly or via freely elected representatives.
2. Each person has the right of equal access to public service in the country.
3. The will of people should be a basis of authority of the government; this will should find to itself expression in the periodic and not forged elections, which should be carried out at the general and equal suffrage, by ballot or by means of other equivalent forms providing freedom of voting.

Each person as the member of a society, has the right to social security and on realization of his advantage necessary for maintenance and for free development of his person of the rights in economic, social and cultural areas via national efforts and the international cooperation and according to structure and resources of each state.

1. Each person has the right to work, on a free choice of work, on fair and favorable working conditions and on protection against unemployment.
2. Each person, without any discrimination, has the right to equal payment for equal work.
3. Everyone working has the right to the fair and satisfactory compensation providing worthy person existence for him both his family, and supplemented, if necessary, other means of social security.
4. Each person has the right to create trade unions and to enter into trade unions for protection of the interests.

Each person has the right to rest and leisure, including the right on reasonable restriction of the working day and on paid periodic holiday.

1. Each person has the right to such standard of life, including I peep, clothes, dwelling, medical leaving and necessary social service which is necessary for maintenance of health and well-being of it both his family, and the right on maintenance on a case of unemployment, illness, physical inability, widowhood, approach of an old age or other case of loss of means of subsistence on not dependent on him to circumstances.
2. The motherhood and infancy entitle to special care and the help. All children who have been born in a marriage or outside of a marriage should use identical social protection.

1. Each person has the right to formation. Formation should be free-of-charge at least in that, as to initial and the general education. The elementary education should be obligatory. Technical and vocational training should be popular, and the higher education should be equally accessible to all on the basis of abilities of everyone.
2. Formation should be directed to full development of the human person and to increase in respect for human rights and basic freedom. Formation should promote mutual understanding, to tolerance and friendship between all peoples, racial and religious groups and should promote activity of the United Nations Organization on maintenance of the world.
3. Parents have the right of a priority in a choice of a kind of formation for juvenile children.

1. Each person has the right to participate freely in a cultural life of a society, to enjoy art, to participate in scientific progress and to use his blessings.
2. Each person has the right to protection of his moral and material interests, which are growing out of scientific, literary or art works which author it is.

Each person has the right to the social and international order at which rights and freedom stated in the present Declaration can be completely carried out.

2. At realization of the rights and freedom each person and his freedom of will should be exposed only to such restrictions what are established by the law extremely with the purpose of maintenance of a due recognition and respect of the rights and freedom of other people and satisfaction of requirements of goods, validity, morals, a public order and the general well-being in a democratic society.
3. Realization of these rights and freedom should not contradict the purposes at all and to principles of the United Nations Organization.

Anything in the present Declaration cannot be interpreted as granting to any state, to group of persons or separate persons of the right to be engaged in any activity or to make the actions directed to destruction of the rights and freedom, stated in the present Declaration.
